Terms of Use
These terms are an agreement between you and ACG Software (acg.software), an independent developer based in Istanbul, Türkiye (“we”, “us”), the publisher of Geode for iPhone and of getgeode.app. By installing or using Geode you accept them. Apple’s Licensed Application End User License Agreement also applies and takes precedence where the two conflict.
1. Licence
We grant you a personal, non-transferable licence to use Geode on Apple devices you own or control, as the App Store Usage Rules allow. You may not copy, resell, reverse-engineer or redistribute the app, its catalog, its price data or its artwork.
2. Free features and Geode Pro
Scanning single cards, your collection, its value and export are free. Rapid Scan is free for 100 cards a month, and the allowance resets each month. Geode Pro unlocks the extra features described in the app, as a monthly or yearly subscription or a one-time lifetime purchase. The price and billing period of each option are shown in the app and on the App Store before you buy, in your local currency, and may vary by region and tax.
3. Subscriptions and billing
Payment is charged to your Apple Account when you confirm the purchase or, with a free trial, when the trial ends. Eligible accounts can start a 7-day free trial of the yearly plan, and we remind you two days before it ends. Subscriptions renew automatically unless you cancel at least 24 hours before the end of the current period; your account is charged for the renewal within the 24 hours before the period ends. Manage or cancel in Settings › [your name] › Subscriptions. If you buy a subscription during a free trial, the unused part of the trial ends. A lifetime purchase is a single payment and does not renew.
4. Refunds
Purchases are processed by Apple, so refunds follow Apple’s policies: request one at reportaproblem.apple.com. We can’t issue refunds ourselves, but write to us and we’ll help where we can.
5. Card identification and prices
Geode identifies cards automatically and shows prices observed by third-party market-data sources, with their source, condition, date and number of sales. Recognition can be wrong and markets move, so check the card and its price before you buy, sell or trade. Prices are reference information: not an offer to buy or sell, not an appraisal and not financial advice. Graded prices and condition information are not a grade and are not endorsed by any grading company.
6. Trademarks and card images
Trading card names, images, set names and symbols belong to their owners. Card images appear in Geode only to help you identify cards. Geode is not affiliated with, endorsed or sponsored by any trading card game publisher, marketplace or grading company. Pokémon is a trademark of Nintendo, Creatures and GAME FREAK.
7. Reports you send
If you send a wrong-card report, you allow us to store and use it, including its card image, to test and improve Geode’s recognition, as the Privacy Policy describes.
8. Acceptable use
Don’t use Geode unlawfully, don’t copy or scrape its catalog, its prices or our server, don’t try to get around purchase checks or usage limits, and don’t interfere with its security or with other people’s use of it. We may suspend access if you do.
9. Warranty and liability
Geode is provided “as is”, without warranties beyond those that cannot be excluded by law. To the extent permitted by law, our total liability is limited to the amount you paid for Geode in the twelve months before the claim. Nothing here limits liability for fraud, or for death or personal injury caused by negligence. Your statutory consumer rights are not affected.
10. Apple
Apple is not a party to these terms and has no obligation to provide maintenance or support for Geode. Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them. Claims about Geode, including product-liability, legal-compliance and intellectual-property claims, should be sent to us, not to Apple.
11. Changes and termination
We may update these terms. We will change the date above and, for material changes, tell you in the app. Continuing to use Geode after a change means you accept it. You can end this agreement at any time by deleting the app and cancelling any subscription.
12. Governing law and contact
These terms are governed by the laws of Türkiye, without affecting the mandatory consumer protections of the country you live in. Disputes go to the courts of Istanbul, unless your local law gives you the right to your own courts. Contact: support@getgeode.app.
